Where the list comes from, and how well it worked last year
The list applies the audit requirement itself to the Department of Labor's public Form 5500 data: the large-plan threshold, the 80-120 rule and participants with account balances. Every number has a source and a date, and we publish how last year's list turned out.

Built on the audit requirement itself
The requirement
A plan with 100 or more participants with account balances at the beginning of the plan year files as a large plan and attaches the report of an independent qualified public accountant.
29 CFR 2520.103-1 · since 2023 only participants with account balances countThe 80-120 rule
A plan that filed as a small plan the year before may keep doing so while it has no more than 120 participants at the start of the year.
29 CFR 2520.103-1(d)The signal
A plan that filed Form 5500-SF for 2025 and reported 121 or more participants with balances at year-end starts 2026 above the threshold. Its 2026 plan year is generally its first audited year.
